The suspect, Darrell Brooks, appeared in court on Tuesday November 23, 2021, in the Waukesha County Court.

The prosecution filed for five counts of intentional homicide as well as counts relating to the critical injuries.

The opening statement from the prosecution stated that another person, a child, had died from their injuries, making the death toll to six.

The defence team for Darrell Brooks only stipulated that in light of Darrell Brooks limited finances that the prosecutions requested for $5 million bail recommendations to the judge, would be disproportionate and Darrell Brooks will not be able to afford bail.

The prosecution set out their argument for Darrell Brooks not to be granted bail, because of his extensive criminal history: battery, violence, violence against women, some being his partners, recently running over a partner earlier in this month.

Darrell Brooks had warrants and other court cases pending and had on several occasions over his twenty-year criminal history he had failed to turn up to court or report back to police and other criminal justice system institutions and partners.

Unfortunately, when an individual has made crime their career as time goes by the crimes can become more serious and be most destructive to those either known by the criminal or people who are strangers and innocent, as in the case of the Waukesha parade massacre suspect Darrell Brooks.

The motive for this heinous crime is unknown and Judge Costello made reference to that. Judge Costello also commented that in his forty years working in the criminal justice system he has never come across a case of this magnitude and with such grave and devastating consequences.

Judge Costello also made it clear to Darrell Brooks who sat hunched over, rocking and it appeared that he was either tearful or crying more probable at hearing Judge Costello saying that if convicted of just one of these offences of intentional homicide, his sentence would be life in prison without the possibility of parole.

Darrell Brooks' defence team know they do not have a chance of defending this case, as the evidence and criminal history against him will lead to his lifetime of detention in an American prison.
